Claim Policy
General Conditions:
Damages to household goods (HHG) may occur during transit due to challenging terrains, such as rough, hilly, or difficult roads. TBPM Express Packers & Movers (TBPM) strongly advises clients to opt for risk coverage at the time of booking, ensuring protection against potential damages during transit. We recommend payment of risk coverage charges via cheque to mitigate unforeseen circumstances.
Please note that the carrier or its agents are exempt from liability for any loss or damage resulting from accidents, pilferage, fire, rain, collisions, or other road or transit hazards. We therefore urge all clients to opt for Carrier Risk Coverage by paying the additional Freight on Value (FOV) charges.
Important:
No individual insurance policy or receipt will be issued. TBPM Express Packers & Movers will issue a Goods Consignment Note (GCN) under "Carrier Risk" as per Section 11 of the Carriage by Road Act, 2007.
General Instructions for Claim Settlement:
Inventory and Packing List:
The consignor must accurately record the value of items in the inventory sheet, which will be used as the final document in any claim settlement. The value declared in the Packing List will be the final amount considered for claim purposes.
Claims will be limited to the amount declared by the consignor in the Packing List at the time of packing.
Claim Process:
Any claims must be reported within 72 hours of delivery (for Car/Bike, within 12 hours).
Claims for damages will only be considered if a written complaint is received within 3 days of unloading.
Damage Acknowledgment:
If the consignor signs the Proof of Delivery (POD) without indicating any damage, it will be deemed that the goods were received in good condition.
The carrier will only entertain claims for items explicitly mentioned as damaged in the POD. Claims for damages to items not listed in the inventory or without mention in the POD will not be accepted.
Damaged Goods:
Claims for material damages will be considered for repair or reimbursement based on the declared value of the damaged items, and only after full payment of freight charges is received.
Excluded Claims:
No claim will be entertained for items previously noted as damaged in the inventory sheet.
Claims for mental anguish, emotional distress, or harassment caused by damages will not be considered.
Claims will not be considered if goods are repaired without informing the carrier.
Claims related to damages during unloading or unpacking performed by the consignor will not be entertained.
Unacceptable Goods:
TBPM Express Packers & Movers will not accept liability for the transport of perishable goods, jewelry, hazardous materials, or flammable substances (such as oils, chemicals, gas cylinders, etc.).
Batteries must be drained of acid before transport.
Exclusions from Coverage:
Claims for damage to flowerpots, lifting or society walls, or minor scratches on furniture will not be accepted.
Any damages occurring due to oil spills or customer-packed goods without proper condition checks will not be covered.
Special Notes for Car/Bike Transportation:
Exterior Damage:
Claims for car/bike damages will only be considered for exterior damages. Internal or mechanical issues (such as engine, battery, A/C, or audio system damage) will not be covered.
The carrier is not liable for mechanical defects or damages to internal components, as they are not equipped to assess these conditions.
Risk Coverage:
The consignor must secure appropriate insurance for the vehicle during transit, as the carrier is not responsible for any damages, accidents, or unforeseen incidents during transportation.
If risk coverage (FOV) is opted for, the carrier will assist with any damage claims, but the consignor must lodge the claim directly with their insurance provider.
Depreciation:
In case of repair, depreciation will be considered for any new parts (10% per year), and claims for NCB (No Claim Bonus) adjustments will be handled by the consignor's insurance provider.
Electronics & Furniture Items:
Electronics:
Claims for AC/fridge gas leakage or refilling will not be covered.
Only authorized service center estimates for electronic repairs will be considered, and compensation will not exceed the declared value.
Internal damage to electronics will not be considered for claims unless specified in the inventory.
Furniture:
Claims for minor scratches or repairable furniture damage will be addressed by the carrier’s in-house carpenters.
Replacement claims for damaged furniture will not be entertained unless it is deemed irreparable.
Repair costs for damaged furniture will be proportionate to the declared value at the time of packing.
Depreciation for Damaged Items:
A depreciation rate of 10% per year will apply to both electronic and furniture items when determining compensation.
GST will only be reimbursed if the final repair bill is provided.
Repair Estimates and Salvage:
Repair estimates must be provided within 5 to 7 working days. Any damaged item taken under 100% declared value will be collected as salvage.
Final Notes:
The consignor affirms that all information provided is accurate, and no prohibited goods are included for transit.
In cases where the consignor has arranged direct insurance coverage, TBPM Express Packers & Movers will no longer be liable for transit risks.
Claims for perishable goods or unauthorized items will not be entertained under any circumstances.
Anti-Trust Charter Policy
Committed to Combating Cartel Behavior
TBPM Express Packers and Movers (TBPM) fully supports the implementation of Anti-Trust compliance programs and is dedicated to combating cartel practices that restrict competition, to the detriment of consumers and the industry as a whole.
What is a Cartel?
A cartel refers to an agreement, collaboration, or conspiracy between competitors with the aim of manipulating or restricting competition. This includes actions such as price-fixing, submitting collusive bids, dividing or sharing markets, or otherwise limiting fair competition.
Cartel conduct is considered one of the most severe violations of Anti-Trust laws in many jurisdictions. The consequences for engaging in cartel behavior can include heavy fines and, in some regions, criminal penalties.
TBPM Express Packers and Movers' Commitment:
TBPM Express Packers and Movers is committed to upholding Anti-Trust laws and operating within the boundaries of fair competition. We will not tolerate participation in any form of cartel behavior. We believe in competing freely and fairly based on the value of our services and products, and we reject any activities that may harm competition or consumer interests.
The Anti-Trust laws in various jurisdictions are designed to promote free, fair, and transparent competition, benefiting both consumers and the industry. As part of our corporate policy, we are dedicated to detecting and preventing cartel practices.
Charter Statement:
TBPM Express Packers and Movers is committed to legal and ethical business practices. We pledge to avoid any behavior that could negatively impact our clients, partners, or the industry. As part of this commitment, we will ensure that all employees are thoroughly informed about Anti-Trust laws related to cartel conduct and other anti-competitive activities.
We will take proactive steps to monitor business partners and employees to ensure full compliance with all relevant regulations and laws concerning cartel behavior.
Legal Compliance:
TBPM Express Packers and Movers will adhere to the laws and regulations that prohibit anti-competitive practices in all the jurisdictions in which we operate.
We commit to staying fully informed of applicable laws regarding cartel conduct and to ensuring that our actions comply with these laws at all times.
Ethical Behavior:
TBPM Express Packers and Movers maintains a zero-tolerance approach to cartel behavior. We promise to act professionally, fairly, and with the highest degree of integrity in all business dealings, wherever we operate.
Commitment to FIDI Values:
This Charter will be integrated into TBPM Express Packers and Movers' quality management practices in alignment with the FAIM (FIDI Accredited International Mover) standard.
By adopting this Charter, TBPM Express Packers and Movers agrees to the following principles:
Prohibition of Collusion:
TBPM Express Packers and Movers will never engage directly or indirectly (through agents, suppliers, or customers) in discussions or agreements aimed at engaging in cartel behavior, including price-fixing, market division, or any other anti-competitive conduct.
Restriction on Sensitive Practices:
TBPM Express Packers and Movers will never propose or enter into agreements with actual or potential competitors regarding:
Price-fixing
Market division, including the sharing of customers or territories
Rigging bids or tenders
Reporting Anti-Competitive Behavior:
Any suspicion or evidence of anti-competitive behavior by competitors will be immediately reported to the relevant Anti-Trust authorities or the company’s legal department in accordance with TBPM's internal reporting procedures.
Trade Association Meetings:
TBPM Express Packers and Movers will not participate in meetings where sensitive competitive issues are discussed. If such topics arise, employees are instructed to immediately request the cessation of the discussion or, if necessary, leave the meeting and ensure this is documented in the meeting minutes.
Clear and Transparent Communications:
All correspondence—whether internal or external, including emails, texts, and documents—will avoid any statements that could be misinterpreted by third parties, Anti-Trust authorities, or courts as indicative of anti-competitive behavior.
Independence in Pricing and Negotiations:
TBPM Express Packers and Movers will maintain independent judgment in pricing and sales decisions, ensuring that these decisions are made based on the value of our services and not on collusion or agreements with competitors.
Limitation of Shared Information:
Information shared during commercial negotiations will be limited to what is strictly necessary for the transaction and will not be disclosed to competitors or third parties unless absolutely required.
Acknowledgment and Compliance:
By agreeing to this Anti-Trust Charter, TBPM Express Packers and Movers affirms the following:
Full understanding of the FAIM Anti-Trust Charter and associated Code of Conduct, which is available in the FAIM Implementation Manual and on the FIDI website.
Non-compliance with the provisions of this Charter is considered a breach of the FAIM pre-requirements and will result in expulsion from FIDI.
Active participation in cartel behavior will be treated as a serious violation of this Charter, and any findings from competent authorities regarding cartel conduct will lead to severe repercussions.
TBPM Express Packers and Movers is dedicated to upholding the principles of fairness, transparency, and integrity in all of our business dealings. By fully committing to this Anti-Trust Charter, we reinforce our pledge to ensure free and fair competition across all markets in which we operate, ultimately benefiting both our customers and the broader industry.
